1. Definitions

• "Tidecraft" or "we" refers to the charter operator registered at 29/3 Soi Pratumnak 6, Bang Lamung, Chon Buri 20150, Thailand.
• "Guest" or "you" refers to any person who makes an enquiry, places a booking, or boards a Tidecraft vessel.
• "Charter" refers to any of our private yacht rental experiences as described on the website.
• "Agreement" refers to the confirmed booking between Tidecraft and the Guest, incorporating these terms.

2. Acceptance of Terms

By submitting an enquiry or confirming a booking, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. You also confirm that any other guests in your group are aware of and will comply with these terms.

3. Services Offered

Tidecraft offers three private yacht charter experiences: the Sunset Bay Sail (approximately three hours), the Day Charter with Crew (approximately eight hours), and the Extended Exploration Voyage (three or more days). All charters depart from Chon Buri province, Thailand. Availability depends on vessel condition, weather, and regulatory requirements at the time of booking.

4. Booking Process

A booking is confirmed once Tidecraft has received your enquiry, confirmed availability, agreed on charter details, and received the required deposit. We will provide written confirmation of the booking along with the outstanding balance and payment due date.

Enquiries submitted through the website do not constitute a confirmed booking until you receive written confirmation from Tidecraft.

5. Pricing and Payment

All prices are quoted in Thai Baht (THB). Current rates are: Sunset Bay Sail — ฿9,800 per charter; Day Charter with Crew — ฿22,500 per charter; Extended Exploration Voyage — ฿28,500 per day (minimum three days).

A deposit is required to secure the booking date. The remaining balance is due no later than 48 hours before the charter departure, unless otherwise agreed in writing. We accept bank transfer and other payment methods as confirmed at the time of booking.

6. Cancellation and Refunds

Cancellations made more than 14 days before the charter date: full deposit refund, less a processing fee of ฿500. Cancellations made 7 to 14 days before the charter date: 50% of the deposit refunded. Cancellations made fewer than 7 days before the charter date: no refund of the deposit.

In the event that Tidecraft cancels a charter due to unsafe weather or vessel conditions, guests will receive a full refund or the option to reschedule at no additional cost.

7. Guest Responsibilities

Guests are expected to arrive at the agreed departure point at the confirmed time. Late arrivals may result in a shortened charter with no refund for lost time. Guests must follow all safety instructions issued by the captain and crew. Any person who appears intoxicated at the point of boarding may be refused boarding, and no refund will be issued in such cases.

Guests are responsible for any damage caused to the vessel, equipment, or crew property through negligence or misconduct. Tidecraft reserves the right to charge repair or replacement costs accordingly.

8. Safety and Captain's Authority

The captain has final authority over all decisions relating to vessel operation, route, and safety at sea. Tidecraft reserves the right to modify or end a charter if sea conditions, weather, or guest conduct creates a risk to safety. In such circumstances, refunds will be assessed on a case-by-case basis.

9. Charter Service Delivery

Tidecraft will make reasonable efforts to deliver the charter as agreed. Route adjustments may be necessary due to conditions beyond our control, including sea state, weather, or Thai Maritime Department restrictions. We will communicate any significant changes in advance where possible.

10. Disclaimers

Tidecraft provides charter services on an "as available" basis. We make no guarantee of specific wildlife sightings, snorkeling conditions, or weather outcomes. Our liability for any disruption to the charter is limited to the value of the charter paid.

11. Limitation of Liability

To the extent permitted by Thai law, Tidecraft's total liability to any guest for any cause whatsoever shall not exceed the total amount paid for the relevant charter. We are not liable for indirect loss, loss of enjoyment, or consequential damages. Nothing in these terms limits our liability for death or personal injury caused by our negligence.

12. Intellectual Property

All content on the Tidecraft website, including text, images, and design, is owned by or licensed to Tidecraft and may not be reproduced without written permission. Guests who photograph or film during a charter may share their own content for personal use, provided it is not used for commercial purposes without our consent.

13. Indemnification

You agree to indemnify Tidecraft and its staff from any claim, loss, or expense arising from your breach of these terms, your negligence, or any unlawful act committed during a charter.

14. Governing Law and Disputes

These terms are governed by the laws of the Kingdom of Thailand. Any disputes shall be subject to the jurisdiction of the courts in Chon Buri province. We encourage guests to contact us directly to resolve any concern informally before pursuing formal proceedings.

15. Changes to These Terms

We may update these terms from time to time. The current version will always be available on this page. Continued use of our services after any update implies acceptance of the revised terms.
